FoodX provides online ordering technology to restaurants and takeaways. Each restaurant has its own ordering website powered by FoodX, and customers use one FoodX account on all of them.
These terms cover your use of this website, your FoodX account, and FoodX's part when you order from a restaurant website powered by FoodX. Our Privacy Policy explains how we use personal data. A restaurant may also have its own terms for its orders. Restaurants that use FoodX sign a separate partner agreement with us, which applies to them instead of these terms where the two differ.
Nothing in these terms affects your legal rights as a consumer.
2. Using this website
- This website gives general information about FoodX. Prices and offers for restaurants shown here are a guide; the binding terms for a restaurant are those in its partner agreement.
- We try to keep our websites available and accurate, but we cannot promise they will always be available or free of errors.
- You must not use our websites for anything unlawful or harmful, try to access our systems or other people's accounts without permission, disrupt our services, copy content or data with automated tools, or send spam or false information through our forms.
- The FoodX name, logo and the content of this website belong to FoodX or to others who allow us to use them. Restaurant names, logos, menus and photos belong to the restaurants.
- We are not responsible for websites run by others that we link to.
3. Ordering from restaurant websites powered by FoodX
Who you buy from
When you order through a restaurant website powered by FoodX, you buy from that restaurant. The restaurant sets its menu and prices, prepares your food and delivers it or has it ready for collection. Your contract for the food is with the restaurant, whose name, address and phone number are shown on its website. FoodX provides the ordering website, the ordering system and your account; FoodX does not prepare or deliver food.
Placing an order
- You need a FoodX account with a confirmed mobile number to order.
- Check your basket, address, contact details and notes before you pay. Every amount that applies to your order, including any delivery fee and service fee, is shown in your basket before you pay.
- The restaurant accepts or declines each order. Your contract with the restaurant is made when it accepts your order. We e-mail you if your order is declined or cancelled, and you may also receive an e-mail when it is accepted. You can follow your order under My Orders on the restaurant website, where your past orders are kept.
- Delivery and collection times are estimates.
- You can order in any language the restaurant website offers.
Payment
Each restaurant chooses the payment methods it accepts, such as card, other online payment methods or cash. Online payments are taken for the restaurant by a payment service provider; we never see or store your full card number. Your first order with a restaurant may need to be paid online.
Cancellations and refunds
- To change or cancel an order, call the restaurant as soon as possible. Once the restaurant has started preparing your food, it may not be able to cancel it.
- If the restaurant declines an order you paid for online, you get a full refund to the way you paid. If it cancels your order after accepting it, you get a refund to the way you paid for anything you did not receive.
- If your food is faulty, not as described or missing, contact the restaurant first. You have legal rights to a remedy, which these terms do not affect.
- Food goes off quickly and is made for a time you choose, so the usual 14-day right to cancel online purchases does not apply to food orders.
Allergies and age-restricted products
Allergen information is provided by each restaurant, which is responsible for it. If you or anyone you are ordering for has a food allergy or intolerance, contact the restaurant before you order. Some products, such as alcohol, can only be sold to people aged 18 or over; the restaurant may ask for photo ID and may refuse to hand them over without it.
4. Your FoodX account
- You must be 16 or over to create an account. One account works on every restaurant website powered by FoodX.
- Give accurate details and keep them up to date. Keep your password secret and tell us straight away if you think someone else has used your account.
- Before your first order you must confirm your mobile number with a code we send by text message.
- To protect restaurants and customers, we use automatic checks against fake orders. You may be asked for an extra check, or orders may be paused for a while. If you think this is a mistake, contact us and a person will look at it.
- We may suspend or close an account that we reasonably believe has been used for fake or fraudulent orders, abuse or a serious breach of these terms. Because one account works on every FoodX restaurant website, this applies to all of them.
- You can delete your account at any time in My account. Some records, such as past orders, are kept as our Privacy Policy explains.
5. Marketing messages
We send offers from restaurants and the FoodX newsletter only if you have agreed to receive them. The choice boxes are never ticked in advance, and you can order without ticking them. Every marketing e-mail has an unsubscribe link, and you can change your choices at any time in My account. Order e-mails are not marketing. See our Privacy Policy for details.
6. Our responsibility to you
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
- The restaurant, not FoodX, is responsible for the food it prepares and sells, including its quality, ingredients, allergen information and hygiene, and for its delivery.
- If we break these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or of our failure to use reasonable care and skill. We are not responsible for loss that is not foreseeable, or for delays or failures caused by events outside our reasonable control.
- Our services for customers are for private use. If you use them for business purposes, we are not liable to you for loss of profit, business or opportunity.
7. Complaints and contact
For problems with your food, delivery or a refund, contact the restaurant first. If the problem is not solved, or your complaint is about FoodX, our websites or your account, contact us at info@foodx.com, on +44 7983 733423, or by post at the address in section 1. Please include the restaurant and your order reference if you have one. We will look into it and reply as soon as we can.
8. General
- We may update these terms when the law or our services change. The date at the top shows the latest version. Your order is covered by the terms in force when you placed it.
- If a court decides that part of these terms is invalid, the rest stays in force. If we do not enforce a right straight away, we can still enforce it later.
- These terms are governed by the law of England and Wales, and the courts of England and Wales deal with any dispute. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
